General Terms and Conditions Definitions

In these General Terms and Conditions the following definitions apply:

  • "vehicle": the vehicle or any other object that is the subject of the rental agreement;
  • "Renter": the natural person or legal entity entering into the rental agreement in the capacity of renter;
  • "Prins Car Rental" (lessor): the natural person signing the rental agreement on behalf of the lessor;
  • "consumer": the client, being a natural person, who enters into the rental agreement other than in the exercise of a profession or business;
  • "rental fee": the amount payable by the Renter to Prins Car Rental, including charges for additional services and administrative costs;
  • "damage": any financial loss suffered directly or indirectly by Prins Car Rental as a result of:
    1. damage to or loss of the vehicle, accessories or parts, or any other object belonging to Prins Car Rental. This includes all costs of repair or replacement, as well as loss of rental income;
    2. injury to persons or damage to property caused with or by means of the vehicle, for which Prins Car Rental, the registered holder of the vehicle, or the vehicle's liability insurer is liable;
    3. damage caused by the authorized driver to Prins Car Rental, for which Prins Car Rental, the registered holder, or the liability insurer is liable, including in particular traffic fines imposed on the authorized driver or penalties imposed by judicial authorities.
  • "Driver": the Renter or the (authorized) person actually operating the vehicle.

1. Determination of rental price, rental period and additional costs

The rental agreement is concluded for the period and at the rate stated in the agreement or otherwise agreed in writing. Return outside opening hours is only permitted with prior approval from Prins Car Rental. The Renter remains liable for all damage until the vehicle has been received and inspected during regular business hours.

The odometer reading at commencement is recorded. The number of kilometers driven is determined based on the odometer. Any defect must be reported immediately.

Charges may apply for preparing the rental agreement, preparing the vehicle for use, delivery, and refueling.

2. Extension of the rental period

The Renter must return the vehicle no later than the agreed date and time unless an extension has been agreed in advance. In case of late return, the Renter owes USD 50 per day (excluding VAT) in addition to the rental fee. A part of a day counts as a full day. No refund is granted for early return.

3. Exceeding the rental period

If the vehicle is not returned within the agreed period, Prins Car Rental is entitled to repossess it immediately.

The Renter's obligations remain in force until the vehicle is back in possession of Prins Car Rental. USD 50 per day (excluding VAT) above the rental fee is due until repossession.

Any judicial costs incurred for recovery are borne by the Renter.

4. Cancellation Policy

Reservations may be cancelled at any time prior to the scheduled pick-up time.

Most reservations are confirmed without advance payment and no cancellation fee will be charged for standard bookings.

Cancellation Insurance ($20) is an optional service and is non-refundable once purchased.

If the vehicle is not collected without prior notice, Prins Car Rental reserves the right to apply a no-show fee where a valid payment method or prepayment exists.

Where any prepaid amount is eligible for refund, the refund will be processed to the original payment method within 5–10 business days.

5. Payment

Advance payment and a security deposit may be required. Any remaining balance may be offset against outstanding amounts.

The deposit is refunded only after return and assessment of damage.

Prins Car Rental may require payment security or credit card authorization, which is irrevocable.

Payment is due immediately after the rental period unless otherwise agreed. In case of default, statutory interest plus 2% annually applies. A part of a month counts as a full month.

Collection costs are payable in case of default, with a minimum of 15% of the outstanding amount.

6. Costs during use

The Renter is responsible for toll charges, fuel, cleaning and parking costs.

7. Use of the vehicle

The Renter must use the vehicle properly and according to its intended purpose. The following rules apply:

  • Only authorized drivers may operate the vehicle.
  • The Renter remains fully liable for damage resulting from unauthorized use.
  • Drivers must hold a valid driver's license and be fit to drive.
  • Subleasing is prohibited without written permission.
  • The vehicle may not leave Bonaire.
  • Overloading is prohibited.
  • Oil levels and tire pressure must be maintained.
  • Incorrect fuel use is prohibited.
  • The vehicle may not be used if unsafe.

In case of damage or incident, the Renter must immediately:

  • inform Prins Car Rental by telephone;
  • follow instructions provided by Prins Car Rental;
  • notify the police;
  • inform Bonaire Security Force (+599 717-9292);
  • provide all relevant information and documentation;
  • submit a completed and signed claim form within 48 hours;
  • refrain from admitting liability;
  • secure the vehicle against further damage or loss;
  • cooperate fully with Prins Car Rental in recovery or legal proceedings.

8. Liability for damage

If no damage is recorded at commencement (Record360), the vehicle is deemed received without visible defects.

The Renter is liable for all damage occurring during the rental period.

If an excess applies, liability per incident is limited to that amount unless there is:

  • violation of section 7;
  • use on unsuitable terrain;
  • intent or gross negligence;
  • subleasing;
  • uninsured third-party liability damage;
  • loss of vehicle, keys or documents;
  • transport of hazardous substances.

In these cases, full liability applies, including consequential damage.

Increased excess:

  • Consumer: maximum USD 1,500 (excluding VAT)
  • Non-consumer: maximum USD 5,000 (excluding VAT)

for damage occurring above two meters in height.

Loss of rental income is calculated as repair days × daily rental rate minus 10%.

9. Repairs

Necessary repairs are at the expense of Prins Car Rental unless otherwise stipulated. Repairs must be carried out at an approved location. A quotation and prior approval are required. Periodic inspections may be requested.

10. Technical defects

If repair exceeds five hours, the Renter is entitled to an alternative vehicle. Prins Car Rental is not liable for transported goods; insurance is recommended.

11. Fines and government measures

Fines and penalties are borne by the Renter. If imposed on Prins Car Rental, the Renter must indemnify upon first request. Administrative costs minimum USD 25 (excluding VAT).

12. Seizure

In case of seizure, payment obligations continue until the vehicle is returned unencumbered. All related costs are borne by the Renter.

13. Termination

Prins Car Rental may terminate the agreement without judicial intervention in case of breach, death, bankruptcy, relocation abroad, seizure, or undisclosed relevant circumstances. The Renter must cooperate in returning the vehicle. No compensation is owed due to termination.

14. Liability for third parties

The Renter is liable for acts or omissions of drivers, passengers, and other users, even without permission.

15. Force Majeure

In case of force majeure, Prins Car Rental may suspend or terminate the agreement without liability. Refunds are provided on a pro rata basis. Force majeure includes strikes, fire, war, epidemics, natural disasters, government measures, and supply disruptions.

16. Limitation of liability of lessor

Prins Car Rental's liability is limited to the amount paid by its insurer.

17. Personal data

Personal data are registered for contract execution and service improvement. The Renter may object to direct marketing.

18. Track & Trace

Vehicles may be equipped with immobilizers, alarm systems, and GPS Track & Trace.

19. Reference check

Prins Car Rental may conduct a reference check and request a fingerprint.

20. Self-service rental option

Customers receive pre-arrival damage documentation via Record360.

Unrecorded damage must be reported with photo before departure.

After leaving the premises, unregistered damage becomes the responsibility of the Renter.

21. Applicable law

All agreements are governed by Dutch Antillean law. Disputes are submitted to the Court of First Instance of the Netherlands Antilles sitting in Bonaire.

22. Additional provisions

These Terms and Conditions also apply to supplementary agreements. In case of discrepancies, the Dutch version prevails.
